what I don't really understand is how he's resigned from the academy, been banned for 10 years from attending, but still gets to keep his oscar.

Ah, that's the way they're spinning it! Took them a couple of weeks but they've managed to come up with the Will Smith = victim scenario. Ask yourself the question: if any of those guys had got up (Weinstein and Polanski aside) and slapped Chris Rock in full view of the world, do you think they'd have gotten away with it too, or do you think they'd have been immediately arrested by the LAPD, and likely never work in Hollywood again? Smith got off very very lightly.
