    A bit of explanation here. Seems they have rights all over Yorkshire, and from that it appears unlikely that they would ever actually seek to extract or unreasonably ransom them.

    They sound irrelevant then. I'm more confused now than before. I fail to see what's holding the consortium back other than if they intended to use the land for other activities outside football.

    Maybe it will actually resolve the stalemate that's currently in place.

    This BBS is quite good when it comes to "research"

    If the current 3 owners of the ground can't come to some sort of reasonable understanding, let the fans be mediator's.

    After all, it's us and our club that is suffering as a result

    I think the problem is the Council and the Consortium have similar interests in the ground. It would be pretty easy to see off the Cryne's as looking onward their only interested is financial.

    Yeah I read the website, which is a bit strange in itself. From the style of it it looks like it was created around 2005 by an amateur and a number of links on there require you to sign in with username and password. I assume this is for people who own land where Hardrof have rights.
    It seems that the law changed in 2013 and possibly that's why they weren't an issue when previous development works were carried out? I've absolutely no experience in this field and am just transitioning back into work whilst carrying out some amateur sleuthing.

    In previous development of oakwell the mineral rights weren't an issue. A couple days before the sale of the club in December 2017 and it's option to buy the ground someone went to the trouble of hiving them off. Beyond that we have speculation. The long standing covenant should have been easily discoverable and if I were the new owners I'd be suing my conveying solicitor if it wasn't spotted. It would appear the covenant is benign unless someone wants to do something else with oakwell. It may also be the subject of high court action if indeed it is perceived to be some kind of impediment going forward. Why Hardof ltd may have bought the mineral rights is also speculation but it gives them the power to be awkward at the very least about development at the ground of any kind.

    I believe the minority holding he had went to someone else. He’s literally got no attachments to Barnsley FC anymore (hence the rumours a few months ago about buying Liverpool and other teams in the Prem).

    Does this not mean that the rights were registered in 2013?

    But as I said above, was the plan for any conveyancing to take place, or simply for the 80%ers to purchase the shares in OCAL? (They should still have checked the title at that stage, mind.)

    So, Oakwell and the surrounding land is owned by James Cryne and Barnsley Council. Presumably that means together they can build a new stand or extend the car parking. The Barnsley Brewery site is now owned by Heineken, so they could build a car park or hotel or whatever on that (subject to planning approval).

    Don't wish to get too involved but from being a bairn I was always told Oakwell could never be used for any other purpose than football. whoever owned it.Is that still the case or have things changed?

    The title publicly available on the land reg shows the current owners of the mineral rights are hardoff ltd and that they acquired them in December 2017. To me it looks like a specific new title was created. The 2013 act relates to manorial rights. If prior to 2017 the mineral rights vested in the manorial rights, then they would have had to be registered by 2013, not so if they just came with the land title. However, I have some land where the mineral rights come with the land and some more land where they were owned by the coal board. I did ask my solicitor what it meant. He told me I could dig on the land but only to a certain level. If I struck spring water or oil and bored down a certain level, the coal authority could claim I was interfering with their rights and stop me. Personally I would imagine a deep foundation pile for a football stand would put you in that zone. Again though it's speculation beyond what the land reg entry says. I did post up the docs on here ages ago, couldn't find them now though.
