    Difficult one. He had been twice tasered to no effect prior to the third deployment of some 30 seconds. It would have been argued (with some force) that the deceased was a man possessed and that in the circumstances the officer’s response was reasonable.

    Although not finding any intent to kill or do serious harm, the jury rejected the assertion that the subsequent kick to the head was reasonable/lawful and this appears to have been the basis of the conviction.

    Using a taser should only be a last resort of your life being in grave danger so someone coming at you with a knife or pointing a gun at you.

    Tasering him for 30 seconds was too far there only supposed to be to restrain a suspect as like you say a last resort. To then kick him in the head twice after is disgusting.

    Feel for the bloke.

    I remember being younger and watching over and over and over, THAT goal. Goal of the season. And I still say to this day, its one of my most favourite ever goals.

    If you have seen the interview with the Officer it’s clear he’s lying saying he thought he had kicked Atkinson in the shoulder , he left boot imprints in DA head he kicked him so hard . Justice done , hope he gets an appropriate sentence

    He'll no doubt be classed as a VP (vulnerable prisoner) so segregated from the rest with the sex offenders etc.

    Not a place I'd like to spend the next 4 years in any case, but then again I don't tend to go round killing people.

    Tasered him for longer than he should kicked him in the head, twice, so hard he left imprints of his boot in Dalian's head. Thats murder in anybody's book, If you or me incapacitate some one, then kicked them in the head twice and killed them, in the middle of the town on a Saturday night we would be banged up for murder and rightly so.

    Should have got double that as minimum what a joke of a sentence, these people are supposed to protect the public hope he gets hell inside, 8 years probley be out in 4 hope the family appeal.

    You wouldn't. I think you'd be initially arrested for murder but likely banged up for manslaughter as murder has to be proved that you intended to kill or seriously harm that person with your actions.
