Tier em3 travel restrictions

    I've just found out today my mum has to have an operation next Friday and needs me to stay overnight with her due to her medication.

    I'm in a tier 2 area, Barnsley will be in a tier 3 area by then. I'm also in a shielding household.

    I read that paragraph earlier, and there was another page that was slightly different that suggested you couldn't mix households at all, even if in a support bubble.

    So we spent several hours trying to decide what was best and safest (seeing as she's had the op put off several times and really cant wait much longer, especially if surgeries are scaled back). The upshot, I'm going to travel from London in the wee hours of the morning, stay two nights and then come back without going anywhere else apart from collect her from hospital with mask and sanitiser galore.

    She later text me saying the next door neighbours were packing up their caravan and trying to head off to Wales!

    Whilst there are people struggling to do the right thing, there will still be people who truly don't give a ****.

    There are exemptions for medical care

    If your mum is over 70 there is no issue - if under 70 its a bit fuzzier

    see General exceptions in relation to gatherings 4.—(1) These are the exceptions referred to in paragraphs 1 and 2. 4....

    (f) to provide care or assistance to a vulnerable person, including relevant personal care within the meaning of paragraph 7(3B) of Schedule 4 to the Safeguarding Vulnerable Groups Act 2006(b)

    Definition
    (15) References to a “vulnerable person” include— (a) any person aged 70 or older; (b) any person aged under 70 who has an underlying health condition, including (but not limited to) the conditions listed in sub-paragraph (17); (c) any person who is pregnant. (16) The conditions referred to in sub-paragraph (16)(b) are— (a) 2000 c. 41. (b) S.I. 2009/649. 20 (a) chronic (long-term) respiratory diseases, such as asthma, chronic obstructive pulmonary disease, emphysema or bronchitis; (b) chronic heart disease, such as heart failure; (c) chronic kidney disease; (d) chronic liver disease, such as hepatitis; (e) chronic neurological conditions, such as Parkinson’s disease, motor neurone disease, multiple sclerosis, a learning disability or cerebral palsy; (f) diabetes; (g) problems with the spleen, such as sickle cell disease or removal of the spleen; (h) a weakened immune system as a result of conditions such as HIV and AIDS, or medicines such as steroid tablets or chemotherapy; (i) being seriously overweight with a body mass index of 40 or above.

    I would hope if your mum needs someone to provide care for her overnight you are forbidden from visiting though I am not a legal expert

    Note there is a difference between advice and the legal (and finable offences)
    It is illegal for you to stay at your mums unless you have a valid exemption but it sounds to me like you have one but the whole regs are hard to really understand - I cant find one specifically that mentions your exact situation

    Thanks for digging that out. I spent a while on the gov site this morning and from the pages I saw, my basis was that there was insufficient clarity to state that i absolutely must not travel, or absolutely must not stay overnight. She has a couple of conditions, but her day surgery is relatively minor. However, her medications add complexity and risk, hence why she's been told not to be alone overnight, which if I wasn't there, she would otherwise be.

    It's extraodinarily frustrating. Particularly as her next door neighbour was literally packing to go away and ignore any increasing in restrictions.

    Just this is unbelievable. We've been trying to do the right thing all year, only seen the grandkids a couple of times. Then you see 2 families of neighbours going out in the same car doing the shopping during lockdown.

    Hope your Mum's going to be OK

    She'll be fine as long as no issues with her existing meds... though she'll be vocal as i've seen her since December, so i may need admitting myself due to a perforated ear drum!!!
