I have to admit that I’m slightly puzzled as to what is expected from the F&P Person test. As far as I know, it is currently basically limited to whether the person involved has a criminal record or has been barred from acting as a company director etc. So how can it be improved? Unless it can somehow be used to predict whether someone is likely to act in a criminally fraudulent manner in the future, by employing Mystic Meg, for example, how is it likely to be improved otherwise?
I don't know how you can change the fit & proper person test to test subjective elements. Whelan would've passed, Davies would've passed at Bolton. The thing that made them so called "good owners" was the fact that they were well intentioned, because they were also fans. How do you measure that objectively at the point of takeover?
I reckon the whole ownership issue is irrelevant tomorrow. They're appealing a points deduction for going into administration. They've gone into administration, it should stand. I'd like to think nothing else should be considered a factor.

Sounds like the Glazier's approach to taking over Man Utd. Take out massive loans on the club to buy the club. If the club defaults, they lose nothing but they get to cream off a share of any profits...
What's "Wigan" though? The fans? The people working for the club? I'd say yes, on both counts. But in that case then "Wigan" have no choice who owns them, which is obviously a huge problem. "Wigan" in this case is actually just a limited company, which can be bought and sold just like any other. The people who have to live with the effects have no say. The German system seems much better, for my money. But that's just from looking in from the outside - I'm sure it brings problems of its own.
I believe they have to satisfy that they have enough money to run the club for 2 years and they self certify this. I believe there should be a 10 year check on all their finances to add to their other stuff (criminal records etc).
Which begs the question of how the new Wigan owner passed, given there's question marks over whether they even exist.
So is this what tbeir legal team is going for? That the EFL said they were ok because they self certified?
If the EFL had rejected the new owner, what would have happened? Surely the chances are the ‘old’ owner would have just said stuff it, especially if we are to believe the new company was nothing mor e than a way to get rid.
