Can't blame them for wanting to protect what they own. I take it WSB had to ask for club permission to release the star shirt even though it was for charity as it mentions in the article owning previous kits.
So anybody who wants to knit their own scarf can't include their own version of Toby Tyke, the colours red and white, the words "Barnsley FC", on it ?? Or home made flags ?? .... without permission.
I imagine if you make something with a club design on it for personal use, that's okay. Making a profit off the club's image is what they're trying to crack down on. Sent from my SM-G900F using Tapatalk
Not that I agree with any of these practices, but isn't the club badge the council's coat of arms? Wish they'd put as much effort into serving me a beer at half time, another revenue stream available to the club that I struggle to hand over to them.
I attended a charity football match at the weekend and found that the local part time team, Shirebrook Rangers, had pinched Toby Tyke, put him in blue shirt and used it as their team logo and had it all over their training kits! Not sure which is worse..... the fact the locals thought it was OK to pinch and use our logo or put poor old Toby in a blue shirt!!
Without being certain , the coat of arms may well be OK to use without permission . Some if not all are considered as being in the public domain .
The reason why people are flogging fakes is simple. Club shop has a piss poor choice of ( if any) merchandise at its two outlets and the stuff they do sell is over priced...
Of course things can always improve but your reasoning doesn't stack up regards the fake sellers' motives. These people are (or were) making money off the back of BFC and without permission. Supporters complain about pricing etc and rightly so in my cases but defending the actions of counterfeiters is at odds with that. Do you buy adidas four stripe trainers because genuine adidas trainers are too expensive? To be fair, some people have asked if they can have permission to use the crest etc on certain goods and had that request granted. Bit of an own goal by those who never thought/chose/cared to. People (me included) have asked for BFC to be run like a multi-million pound business should be. Protecting your brand and assets is common business sense.
I can see where they are coming from but the statement from the club seemed a little harsh to me, a bit like if you lend £20 off a mate, don't mention it for a bit, and all of a sudden he wants to take you to court without saying a word about it. How much is this consultancy firm charging them? I doubt there's a factory knocking this stuff out 24/7, we're only Barnsley. If I make a T-shirt with 'Teams like Barnsley' on it, does that come under this? What about the badge man? He does my head in sometimes, and I never buy a badge, but he's not exactly Pirate Bay is he?
It's not really like lending a mate money because the club haven't given the counterfeiters permission to use their stuff. It's more like you notice that someone has knicked your sandwich from the fridge at work but you don't say anything because its only a sandwich, then somebody does it again and again and it starts to piss you off a bit, then you go into work and a tenners missing from your desk drawer. You have a wedding with your boss about it and decide to do an investigation, next day you go in and £20 is missing along with your sandwich and a Mars bar. You and your boss decide that enough is enough and whilst sacking Andy from sales because he was caught on CCTV eating your sarnie and had chocolate all round his fat little face the boss sends out an email telling everyone that anyone caught taking anything that isnt theirs will be prosecuted.
